The Louisiana Workforce Commission has received a judgment from District Judge Don Johnson of the 19th Judicial District Court preliminarily enjoining the Office of Workers' Compensation medical director from reviewing medical treatment disputes for compliance with OWC's treatment guidelines.
The guideline process was enacted at the direction of the Louisiana State Legislature in 2011 to expedite proper medical treatment for injured workers so that they can recover sooner and return to work faster. The implementation of the guidelines and the determination process has helped to improve care for injured workers while also eliminating cost increases for employers. In fact, rate decreases have been approved for the past two years.
The LWC will seek a stay of the judgment and appropriate review by higher courts to keep this game-changing reform in place so that it can continue to benefit all stakeholders. In the interim, the agency will comply with the district court's order. Pending further proceedings, OWC's medical services section can no longer accept requests to review medical treatment disputes under La. R.S. 23:1203.1.
